When you participate in the community submission, we may process information including:

• your submitted photo
• photo credit information
• information provided with your submission
• technical information generated when using the submission form

The submitted photo may contain personal data relating to you or other identifiable individuals.

Depending on the content of the photo, it may also reveal special categories of personal data, including information relating to a person's sex life or sexual orientation.

3. Why we process your data

We process your information to:

• administer the cuffed calendar 2027 community submission
• review submitted photos
• communicate with participants
• organize the community voting
• display selected submissions publicly
• contact participants whose photos are selected for the final calendar

Where you have consented to publication, your submitted photo may also be used to promote the cuffed calendar 2027 community voting through cuffed.store, cuffed social media channels and email newsletters.

4. Legal basis

Personal data required to administer your participation is processed where necessary for your participation in the community submission in accordance with Article 6(1)(b) GDPR.

Publication of your photo for the community voting and related promotion is based on your consent under Article 6(1)(a) GDPR.

Where a submitted photo reveals special categories of personal data, including information concerning sex life or sexual orientation, processing is based on your explicit consent under Article 9(2)(a) GDPR.

Where necessary, we may also process limited information to document permissions, protect our legal rights and defend against legal claims.

5. Photos containing other people

If another identifiable person appears in your photo, you must ensure that this person has been informed about the intended processing and publication and has explicitly agreed to it.

This is particularly important where the photo may reveal information concerning that person's sex life or sexual orientation.

We may request written evidence of this consent or a separate Model Release before publishing the photo.

6. Public publication

Photos accepted for community voting may be made publicly accessible on the internet.

This means that people worldwide may view the photo. Third parties may also save, share or redistribute publicly available content outside our control.

You should only submit a photo for which you and every identifiable person shown are comfortable with this level of publication.

7. Recipients

Your personal data may be processed by service providers that support the operation of our online store, submission form, file storage, hosting, email communication and other technical services.

Photos selected for public voting will also be accessible to visitors of cuffed.store and may be published through cuffed social media channels or newsletters as described above.

Service providers only receive data where this is necessary to provide the respective service.

8. International data transfers

Some of the service providers used for our website, online store, communications or social media may process personal data outside the European Economic Area.

Where required, such transfers are protected by an adequacy decision of the European Commission or other safeguards provided for under the GDPR, including Standard Contractual Clauses.

9. Storage period

Submissions that are not selected for the final calendar will generally be deleted within six months after completion of the community voting, unless longer storage is necessary to document consent, permissions or defend legal claims.

If your photo is selected for the cuffed calendar 2027, the further processing and storage of the photo will be governed by the separate Photo License and Model Release.

If you withdraw your consent, we will stop consent-based future processing and delete the relevant data where no other legal basis or legal retention requirement applies.

10. Withdrawal of consent

You may withdraw your consent at any time with effect for the future by contacting hello@cuffed.store.

Withdrawal does not affect the lawfulness of processing carried out before the withdrawal.

Where a photo has already been publicly distributed, we will remove it from channels controlled by Black Carrot GmbH where reasonably possible.

We cannot guarantee removal of copies that have already been saved or independently shared by third parties.

11. Your rights

Under the GDPR, you may have the right to:

• request access to your personal data
• request correction of inaccurate data
• request deletion of your personal data
• request restriction of processing
• request data portability where applicable
• withdraw your consent at any time
• object to processing where applicable

You also have the right to lodge a complaint with a competent data protection supervisory authority.
